Please read these terms carefully before using our website or engaging any of our services. By using this site or booking a session, you agree to the terms described below.

1. Definitions

In these Terms and Conditions, the following words carry the meanings given here:

  • "Goldyear", "we", "us", or "our" refers to Goldyear, a pension information and education provider operating from 142 Thanon Phuket, Talat Nuea, Phuket 83000, Thailand.
  • "Service" or "Services" refers to the information sessions, printed and digital guides, and workplace information programmes offered by Goldyear, as described on this website.
  • "User", "you", or "your" refers to any individual or organisation accessing this website or engaging our Services.
  • "Content" refers to all text, templates, slides, guides, and materials produced or supplied by Goldyear.
  • "Agreement" refers to these Terms and Conditions together with any applicable booking confirmation or programme agreement.
  • "Session" refers to a scheduled one-on-one or group meeting delivered by Goldyear in person or remotely.

2. Acceptance of Terms

By accessing this website or booking a Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not use this website or engage our Services.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law. If you are booking on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Agreement is formed at the point of booking confirmation. We may ask you to confirm acceptance in writing for workplace programmes.

3. Our Services

Goldyear provides pension awareness and retirement information services. All content is general and educational in nature. We do not provide personalised recommendations, regulated advice, or decisions of any kind on behalf of any individual or organisation.

Our current Services are:

  • Getting Organised: Starter Session — a one-on-one organisational session to help map documents and accounts, with templates to take home. No document interpretation or guidance on personal choices is included.
  • Family Conversation Guide — a printed and digital guide with optional walkthrough, offering prompts to help families discuss later-life plans. No recommendations are made.
  • Workplace Information Programme — a packaged employer engagement providing informational content, slides, and a facilitator outline to help staff understand workplace retirement benefits in plain terms.

Services are available primarily in Thailand. We reserve the right to decline a booking if we are unable to deliver the Service to the requested location or in the requested format.

Session availability is subject to our schedule. We will communicate confirmed dates and details in writing after booking.

4. Your Responsibilities

When using this website or engaging our Services, you agree to:

  • Provide accurate and complete information when making a booking or enquiry.
  • Use our website and materials for lawful, personal or professional informational purposes only.
  • Not reproduce, distribute, or repurpose our Content without prior written permission.
  • Treat our staff and facilitators with courtesy and respect during all sessions.
  • Notify us promptly if you need to reschedule or cancel a booking.
  • Not use this website or our materials in a way that could mislead others, damage our reputation, or cause harm to any third party.

For workplace programmes, the booking organisation is responsible for ensuring that the session environment is suitable and that staff participation is voluntary and clearly communicated as informational only.

5. Intellectual Property

All Content on this website and within our Service materials — including text, templates, slides, guides, and structural frameworks — is the intellectual property of Goldyear unless otherwise stated. All rights are reserved.

We grant you a limited, non-exclusive, non-transferable licence to use materials provided through our Services for personal or internal organisational purposes only. This licence does not permit you to reproduce, sub-license, sell, or publish our Content.

Templates provided through the Starter Session are for your personal organisational use. Guides provided through the Family Conversation Guide may be shared within the immediate family group for which they were purchased, but not redistributed commercially.

Materials supplied to organisations through the Workplace Information Programme are licensed for internal use within the purchasing organisation for one delivery cycle, unless a written renewal or extension has been agreed.

Feedback or suggestions you share with us may be used by Goldyear to improve our Services without obligation or compensation.

6. Payment & Refunds

All fees are quoted and charged in Thai Baht (฿). Current service fees are:

  • Getting Organised: Starter Session — ฿3,600
  • Family Conversation Guide — ฿6,800
  • Workplace Information Programme — ฿11,200

Payment is due before the session or delivery of materials, unless a written arrangement has been made for organisations. We will confirm accepted payment methods at the time of booking.

Cancellation and rescheduling: If you need to cancel or reschedule, please contact us as soon as possible. Cancellations made more than five working days before a scheduled session will receive a full refund. Cancellations made within five working days may receive a partial refund at our discretion, depending on preparatory work already completed. Workplace programmes require notice of at least ten working days for a full refund of the programme fee.

If Goldyear is unable to deliver a confirmed session due to circumstances within our control, you will receive a full refund or the option to reschedule at no additional cost.

7. Service-Specific Terms

Starter Session: Sessions are scheduled individually and take place in person or remotely. The session is focused on organisational mapping only. No record of your personal documents is retained by Goldyear after the session unless you have separately agreed to a follow-up service.

Family Conversation Guide: Printed materials are prepared individually and will be dispatched or made available to download following payment. The optional walkthrough, where chosen, is scheduled separately. The guide is designed as a conversation prompt and does not constitute advice on any personal decision.

Workplace Information Programme: This programme is agreed on a per-organisation basis. Scope, delivery format, and session count are confirmed in a written programme agreement prior to commencement. The programme fee covers content, slides, and a facilitator outline for one delivery cycle. Changes to scope after agreement may affect the fee, and any adjustment will be communicated in writing before it takes effect.

8. Disclaimers

Goldyear is an information and education resource. Our Services and website content are provided for general awareness only and do not constitute advice of any kind — including personal, regulatory, or professional guidance of any description.

Nothing in our materials should be taken as a recommendation to make or avoid any particular decision. You should seek independent qualified guidance appropriate to your own situation before making any significant personal or organisational choices.

This website and its content are provided on an "as available" basis. While we take care to keep information accurate and current, we make no representation that all content is complete, error-free, or appropriate for every reader's circumstances.

Links to third-party websites are provided for reference only. Goldyear has no control over those sites and accepts no responsibility for their content or practices.

9. Limitation of Liability

To the fullest extent permitted by applicable Thai law, Goldyear's total liability to you arising from or related to these terms or the Services shall not exceed the total amount paid by you for the specific Service giving rise to the claim.

Goldyear shall not be liable for any indirect, consequential, or incidental loss arising from your use of this website or our Services, including but not limited to any decisions made in reliance on general information provided.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under Thai law.

We are not liable for delays or failure to deliver a Service caused by circumstances beyond our reasonable control, including natural events, infrastructure disruption, or public health measures.

10. Indemnification

You agree to indemnify and hold harmless Goldyear, its staff, and associates from and against any claims, losses, or expenses (including reasonable costs) arising from your breach of this Agreement, your misuse of our Content, or your infringement of any third-party rights.

For organisations: you accept responsibility for ensuring that materials and sessions are communicated appropriately to staff participants and that their use of any materials complies with these terms.

11. Termination

Either party may bring an engagement to a close by providing written notice. In the case of a session or programme already underway, the notice provisions in Section 6 apply regarding any applicable refund.

Goldyear reserves the right to decline or discontinue a booking if the engagement cannot proceed in a way that is consistent with our educational remit or these terms.

Upon conclusion or cancellation of a Service, your licence to use the associated materials remains for the purposes described in Section 5, unless otherwise agreed in writing. Sections 5, 8, 9, 10, and 12 survive the termination of any Service engagement.

12. Dispute Resolution

These Terms and Conditions are governed by the laws of Thailand. Any formal proceedings would be subject to the jurisdiction of the competent courts of Thailand.

Before any formal process, we encourage you to contact us directly. Most questions or concerns can be addressed through a straightforward conversation, and we will always make a genuine effort to reach a fair resolution.

If an informal resolution is not reached, the parties may consider mediation as a first step. Contact details for reaching us are in Section 15 below.

13. General Provisions

Entire Agreement: This Agreement, together with any written booking confirmation or programme agreement, constitutes the entire understanding between you and Goldyear for the relevant Service.

Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect.

Waiver: Our failure to enforce any provision of this Agreement does not constitute a waiver of our right to enforce it at a later point.

Assignment: You may not transfer your rights or obligations under this Agreement to any other party without our written consent. Goldyear may transfer its obligations to a successor organisation, provided your rights are not materially affected.

Notices: Written notices may be sent to the contact details in Section 15. Electronic communications to our stated email address are considered received on the day they are sent, provided no delivery failure is returned.

14. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our Services, practices, or applicable law. When we do, we will update the "Last Updated" date at the top of this page.

Changes take effect from the date shown. Continuing to use this website or our Services after an update constitutes your acceptance of the revised terms. We encourage you to check this page periodically if you engage with us regularly.

For active workplace programme agreements, material changes to terms will be communicated in writing to the relevant organisation contact before they take effect.
